    Child support question?

    My wife is having trouble getting child support from her ex-husband. Her son lives with us full time and his dad sees him every other weekend (when he decides to come get him). He is supposed to be paying 85.00 per week and is currently 6000.00+ behind as he might pay once every 2 months. Now his income tax is supposed to cover any back child support that he is behind, but the problem is that he seems to be working for cash. He tells her that he just doesn't have the money to pay the child support, but he opened his own auto repair garage, he buys new vehicles every other week, he just bought a new house, and to top it off, we just found out that his 18 year old girlfriend is pregnant (he is almost 40). My wife has been talking to her case worker that handles her case (when she can actually get her on the phone) and she just gets the runaround. My wife is really fed up with all of this ( I am too, but I try to stay out of their situation). And on top of all of that, his dad keeps threatening that when Jacob turns 12, he is going to take them to court and get Jacob to tell the judge that he wants to live with his daddy. Anyone got any suggestions? His dad is a real piece of crap! For example, this weekend he went to his dad's. He had on a good pair of school shorts and a new pair of Nike tennis shoes that we had bought him for school. He comes back with crappy old shoes, and some torn up blue jeans. His dad will keep the stuff that we buy him over there, so he don't have to buy anything. And what is bought for Jacob over there comes from his grandma. Not to mention the fact that his daddy didn't even make him brush his teeth the entire weekend!! It's ridiculous!

    Should we be talking to a lawyer or what? We really don't have the money to hire one and take it to court....but something needs to be done.

    go find the free legal aid in your town usally near the sherrifs office you will need a lawyer if child support is not taking him to court like they are supposed too, i would go to the cs office and demand to talk to a supervisor

      IS IT SET UP THROUGH DHR? THAT WAY HE HAS NO CHOICE. ITS TAKEN FROM HIS PAYCHECKS AND YOU GET A CHECK CUT TO YOU ON THAT MONTH. THATS HOW ITS DONE FOR MY STEP DAUGHTER WITH HER DAD. HES A DEAD BEAT TOO!

      AS FAR AS THE BACK CHILD SUPPORT, I THINK YOU WILL NEED A LAWYER FOR THAT...

          It's set up like that but he has worked for cash for like 1.5 years...so there is no check. He doesn't file for income tax because he works for cash, so there is no check there either.

          Supposedly the child support services has done some kind of paper work (they take it upon themselves to do this...we didn't even know it was going on) that they send to the local police department and he will be arrested. They said that to get out of jail, he will have to pay 10% of what he owes in back child support. This sounds like something is being done, right? Well, the lady also told us that once they send out the papers, it has to go through so many different hands before action is taken, that she has no clue how long it will take. The secretary for this lady says that she knows they have some cases where the paperwork was sent out over a year ago and the guy still hasn't been arrested. Needless to say, she doesn't have her hopes up.

            friend of the court....they'll go after him for you.

              I think you may need to get an agressive attorney after him and his assets. I beleive all his assets can be subpoenaed into court for distribution and...if its proven he is working for cash and not claiming it as income, he will owe back taxes

                If he is behind in child support whi isnt she throwing him in jail. Yes see a lawyer.

                  She is trying through the child support people but they SUCK and don't seem to get in a hurry about anything. I wish we had the money to get a lawyer because I can't stand the fact that he is getting away with this crap. He doesn't support his child in any way other than a go kart that he bought him at his house. I have done by FAR more for Jacob than his dad has. And the only reason he does that cash work is so he can get away with not paying the child support. He hasn't even bought him any clothes or anything that he needs in over a year. I mentioned above that Jacob came home from his house this weekend and hadn't brushed his teeth all weekend...well, she called his dad and asked him why and his response was that Jacob didn't have a toothbrush. His dad works right beside a wal-greens! Or even stop by a dollar store and get one for 1.00. What a lame a**!! And now he is going to have another kid. It's crazy.

                    Whenever I have a legal question, here is the place I post first. You get some real idiots on there who THINK they're lawyers. But usually, the real lawyers set them straight, and you'll get a good answer. Here pally:
