There isnt a disclaimer in existance that cannot be challenged in a court of law. As opposed to a court of bubblegum, which is just stupid.

But good luck winning that challange. You need a better argument than "But that shouldn't apply to me, only the rest of the world".RIP BigJim33 & GearedUp: You are sorely missed my friends.

I would sue for the price paid. Doctors dont want their malpractice insurance premiums to go up anymore than they normally do.
But it sounds like he messed up pretty good. Have your mom talk to someone who specializes in medical suits. Not the suits you wear either.
Yea, that wasnt funny was it?

However, I was also told that most eye surgery centers will refund at least a portion of the money if no improvements are made.
Definately have a lawer check out the case tho. Maybe your mom got lucky and they forgot to get her to sign the disclaimer.RIP BigJim33 & GearedUp: You are sorely missed my friends.

If the doc does everything by the book and it doesn't work = Out of luck
If the doc does the procedure wrong or forgets to do something = Malpractice.
What exactly did the Doc forget to do? Surgery isn't something where it's easy to accidently skip a step.RIP BigJim33 & GearedUp: You are sorely missed my friends.

Hopefully you'll have the proof to prove it in court!
Good luck!RIP BigJim33 & GearedUp: You are sorely missed my friends.
