    PI is the worst he can be charged with. you cant get driving under influence without driving. if the cop didnt see you drive then there is no charge he is just hoping he will not fight it cause it looks good on his call log. also he would have to have witnesses file an offence report to charge him if he didnt see it and even then the stand if it went to court.

Luckily I kept my mouth shut but I feel bad because this all started after the police were called because of a near brawl...it was 3 guys on me and punches were not thrown but the clerk called the cops. No word from him yet. THIS SUCKS!

      I dont think he can get a ticket cause he was not driving yet, but I think the best thing the cop could have done is prevented this and at least try to to you all go find a ride or call someone to pick u all up. I hope your buds alright.

        The Keys must be in the ignition for it to be considered dui. I had some experience with this. I passed out in my car at a club with the keys in the ignition, car was not running, and a PIG arrested me for DUI. My attorney told me that if they were not in the ignition then they wouldnt have a case!

          in FL you have to have the keys in the ignition in order for them to give you a DUI, otherwise, it's not happening
