    I disagree. If all we are talking about is a possession charge, then the state (or feds) would have to prove that you actually possessed a controlled substance - which they could not do. Just like they couldn't bust you for having oregano wrapped up like weed. As was said above, if you try to sell it, that is a completely different story. Then the laws that were mentioned above take effect and you can be busted for the attempted sale. The only wrinkle I see to possession alone would be if you had enough that they could argue "intent to distribute". Then they might be able to get you, but again it isn't for possession but for an intent to sell it.

      If you rob a liquor store with a toy gun, you will still be charged with ARMED robbery. It's all about intent.

          I don't think it would matter whether or not it was fake or not. Once it gets into the D.A's hands they'de prob. try to prosecute people for anything. THey really don't give a fuck about anyone except their own numbers and how many people they can convict. The sneaky bastards would think of something to bag you with.

              this is true and i agree that the intent and everything is there if he was to buy or sell them as AAS but he is simply holding oil in a vial, not trying to buy or sell it.

                It is obvious that many of you here have spent very little time in a courtroom (that’s a good thing ).

                Honestly, even with only a semi-decent lawyer, a case like that would get thrown out of court so fast it would make your head spin. Especially if you are in a big city – they don’t have time to screw around with stupid shit like possession of…nothing.

                The worst you might get hit with would be possession of drug paraphernalia, which is about as heavy a charge as urinating in public.

                  This is kind of what I'm thinking. Sure the cops are going to bust you. Now it depends what happens in court. The prosecution is going to argue what everybody is saying here, "intent" The defense lawyer is going to argue, "but it's not real" I think when it comes down to it, it's whoever is the better lawyer.

                    Having fake stuff is not illegal. Assuming you don't get fake stuff from your pharmacy when you turn in your prescription, what you do to get the stuff (even if it turns out to be fake) is illegal.

                    If the state found vials of clear fluid in someone's home while searching for something else there could be no possession charge b/c it's fake. But if they found out that the fake stuff was purchased illegally (going back to everyone's intent comments) ie. that person attempted to buy scheduled substances illegally, you can be busted. Or even worse if you decided to scam someone by selling it and got caught - straight to jail - doesn't matter if it's real.

                      they would probably charge you with paraphanelia, and that's about it...how in the hell would they charge you with fake oil or intent, you would beat that with an attorney, or even by yourself...kind of like trying to charge someone with fake blow, it wont stick, intent or no intent.....
