      Last years tax returns show that he made $117,000. He was making $75k a year but right before the case went before a judge, his pay was supposedly cut in half. He has the kids every other Thursday at 5pm until Sunday at 5pm and every other Tuesday from 4-8. I have the majority of custody.

      It's time to ask your attorney who he's/she's really working for. If he made more than 100K, he should be giving you at least 20-25K for child support, regardless. Somehow, his lawyer is claiming less salary now.

      If you have majority custody and that is all you are getting you are getting screwed. I don't know what your state is in but you should be able to apply for a court appointed attorney. I wouldn't shy away from a court appointed attorney as it should be a pretty cut and dry case on how much money you get...which should be a LOT more than you are now.

      You should be able to review his income every so often and when his pay raises I know of PLENTY of my friends that get hit all the time. I'm not for screwing the man over or vice versa but if that's all you are getting and he isn't even offering any more then i'd take his ass back to court. I'd call up someone in your state and they should be able to provide you help.

      stouts right a court appointed attorney will fix this for you. But then again I dont know if a they give you a court appointed attorney in a child support case you might have to get one on your own. But it would be wirth it because you should be getting more money quirky big time. check the laws again in your state. I know in ilinois you get robbed big time you pay out of your ass,lol. Not me ofcourse I dont beleive in divorce but working for the airlines all these guys are divorced and paying for 234 kids. I dont know how they live some times.there just working all the over time to pay for there kids

      It looks like if you have to take him back court that your lawyer can also get the courts to make him pay for you legal fees. Wouldn't hurt to ask...

      In my state you do not neccessarily have to have an attorney....just contact the Office of Child Support Enforcement. They do all the work for you.

      Even if the guy's pay is cut in half ($36,000) he should still be paying quite a bit more than what he is right now. I would definitely check into it.

      Hell, I pay over $600 a month for two and don't make SHIT....lol.

      Thats right. If it is just for child support and not over a custody battle/agreement, a majority of states have domestic relations or social services departments where the two parties go in and a moderator sets an amount based on income.

      They will give you two a chance to agree on an amount of support/compensation, medical expenses, transportation, etc. If an agreement cannot be reached, then the moderator sets an amount the computer determines based on income of the payee. No lawyer necessary for ANY of these kinds of proceedings.

      Quirk- I work with guys paying $1100/month for 2 kids in that income braket- you definately need to take him back to court. I'm sure there is an attourney that will work with you

      Im telling you, there is no need for an attorney to request for a child support modification, unless custody is in question. Just file for a modification and let the moderator do the rest, unless you guys can agree on a figure w/o the mod. which sounds unlikely

      Ok so here's an update - the ex was supposed to pick up the kids tonight for his court appointed visitation. He NEVER showed. He wanted me to take the baby this weekend so he could take the older kids to Bristol for the Nascar race. This would not have been a problem if he hadnt told the kids they were going BEFORE he asked me and not only that, asked me just this past Tuesday to take the baby for the weekend. I've already scheduled myself to work so I said no especially since every extra hour I work - I get paid for. If he has the kids, he should do something he can do with all the kids, not part of them. I would never say "Hey its my weekend - but can you take a kid or two since I have something to do?" Bullshit. Oh - and I should say - he lives with his mother.
      So I call him and he's at his girlfriends house (you can hear her kids in the background) and he says his back hurts and he cant take the kids. I tell him he has to and he starts screaming at me that im a psycho ****ing ***** so loud that the kids can hear. What a pathetic piece of shit. Ugh

      There are two sides to this story. Did anyone actually sit down and figure what the basic sustanance of a child is per month? Nope! Everyone just hears about what someone else is getting and expects more and more.
      Most states have a chart for gross income and go accordingly but some judges can impune more. If he is receiving a w2 for that amount and a judge awarded $200 something a month for three kids, I call bullshit. He must have expenses against that income and it probably was reported on a 1099. What needs to be deterimed is his NET number and about 25% (in most states) of that number will apply.
