  • Officer Dum****!

Yeah yeah, I know...I used to be one. But fortunately, I was never hit with the "stupid wand".

A couple of weeks ago, I was pulled over just minutes after leaving work. I knew the dum**** was going to pull me over because he was tailing 4 feet behind me for about 2 blocks before flashing his lights & siren. Of course, I have major attitude because I know that I was not speeding or anything so there was NO reason for me to be pulled over. But the "rookie" apparently ran my plate as he was tailing me, which he really had no reason to. But okay, little did I know, I have a warrant on my registration, due to a mere $14 re-instatement fee that I failed to pay last year when I was going through a couple ticket issues.

But once I've paid the $14 to Cali's DMV, the ticket will be squashed, although I'll probably have to miss a day of work to drive 50 miles to court. Why, you ask, will the ticket be squashed? Because the dum**** has 3 false statements on my ticket:

    1) He has my race as being White. Now I'm pissed because in the 48 years on this planet, none of my parents ever told me that I was WHITE....Not that there's anything wrong with that.

    2) He has my weight as being 315. Funny thing is, he should have noticed a skinny face and muscular arms in the truck. Sure, I wish I was about 315 with 8% bodyfat but that's wishful thinking. Right now, I'll settle for the current 260 that I weigh. As for the bodyfat, that's debatable.

3)AND MY FAVORITE.....He clocked me going 35 miles on a 30 mph road. Well, he's half right. I stand corrected, I was going about 35 before he was bored enough to pull me over. But there's not a 30 mph area any where near my job. There are 45 mph signs posted for miles in that area.

But I'm proud to say that I made him feel stupid because he claimed that the warrant was since 2008 and that it may have had something to do with a brother or relative of mine named Carlos and Marco. I replied, "That's interesting since I only bought this SUV in February, 2009. And if you'd noticed on the license, Sir, I'm not sporting a Mexican name. It's French." I truly hope that Officer Dum**** will be in the courtroom when I go there to present his stupidity to the judge.

white is anything other than black. at least thats how we fill in race on our cites. if a person is arrested they will get designated white (hispanic) or other race.

as for the weight issue it wont win you anything in court as the citation is not the charging insturment. only way a cite can get you out of a ticket is if he has the time or the incident street wrong or some other fact that is a mistake.

i would drive your route and take pics of the 45 mph limit. then drive to where he pulled you over. if indeed you were going 35 in a 45 then the prosecutor before the case goes to court will most likely dismiss the case upon a "not guilty plee"

      good luck bro

The cop cars here just got those automatic license readers. Anyone that goes by it reads the plates and searches for warrants instantly. No more putting off paying tickets now!

Granted, the issues that you've presented are correct, to a certain degree.

          1) RACE: I remember a case in Louisiana where a very white looking woman was fighting to have her legal race changed to white. The problem was that, in Louisiana, if you have a minimum of a 1/3 Black blood, you're Black. Granted, I'm in Cali. And while my race is often mistaken for Hispanic, it's more obvious, particularly from my Southern accent, that I'm not Hispanic nor White.

          2) WEIGHT: Technically, it can pose a problem since most defendants would and could claim that it was not them driving the vehicle, since the weight on the ticket is false. Therefore, the person, being the registered owner, can't be charged. But in this case, it doesn't apply and I won't entertain that thought in court, other than it being obvious that I'm not 315.

          3) You're 100% right and planned on do just that. I will also point out that this street runs through about 8 different cities. I pass through 3 of them while driving to work and the speed limits are 40-45 mph in all 3 cities.

DAMN ROOKIES! He should have known that beforehand.

            3).

on our citations we write "W" or "B" there is no in between. many hispanic folk fight the citation thinking they have it beat and they loose every time.

again the citation written to you is not the charging instrument it is merely a summons to appear before the municipal court

unless he wrote down the incorrect address or birthday ect. the race card wont help you. at least not in Texas

also the weight thing. it is estimated. we dont even fill in weight many times. we used to ask the person but many women would say "128" when it was closer to "170". my buddy told a lady "not the weight you wre when you were 12, I mean now" he got written up but said it was worth it LOL

the speed limit is all you need to beat it.

I see your point, bro, and you're right. In our case (NOPD), when a race is unable to judge, we'd leave it blank, since it's always simplier to just run the name/DOB on NCIC and get anything and everything that you need to know.

But being that I'm a fair skin black guy (Creole, according to Louisiana), it's often difficult to determine whether I'm Caucasian or Hispanic, unless I speak and reveal my strong Southern accent. LOL

i feel ya bro. IMO on our citation books it should say color and not race. it does upset folk and alot of people end up paying court cost because of the oversight
