    I hear you energy - thats the problem - he lied about his current income, is claiming ridiculous expenses - $5000/month for mortgage!! His mother owns the home he lives in, he pays no rent (according to her testimony) and I pay our mortgage. The problem is - the mortgage on our house (the house I love in with the kids) is in both our names still so he claimed it - the judge was totally confused. And hes claiming $600 a month in health care. And on this years taxes and last years - he claimed all the mortgage interest and the kids. He ****s me both ways to Sunday on everything.

      There you go! My point exactly. It seems as if they don't even care. WTF. It happened in reverse to me for eight months and I was paying (if I told you the amount, you wouldn't believe it) then she orders a silly low amount and like an idiot I wanted to make it fair and asked for a larger amount.

        In NC, child support is run through the Dept of Social Services. They set the rate for with holding child support. The max is 40% of the weekly gross salary. Each employeer has to send a check weekly to the State of NC/Child ServicesDiv of Social Services. We are undrer state law to with hold it from the employee's check and submit it to the NC Dept of Child Services.
        If Va has a DSS, check with them, they may be able to help you without having to hire a lawyer

          Yep thats exactly how it works. No need for a lawyer, unless to investigate the allegations of him claiming false income and expenses. But not to file.

            Expenses??? In Texas they only look at your income- they don't give a sh*t about your expenses- got many co-workers that had to sell everything becsude they could no longer afford to live they way the were and the judge to them they didn't care.

              The same in PA and MD. They dont care what your bills or what your financial obligations are. I dont know how it works with the guys that father 18 kids by 18 different woment, but for the most part...its your gross and thats that. Thats why I dont understand why a judge is even entertaining his expenses or mortgage or whatnot.

                They don't care about your expenses. We had one employee that by the time DSS got through with him and his monthly necessities, he had 3.00 left. He asked for some relief. The DSS case worker told him to find a part time job, but they would need to be notified about a second job. The reason? So they could take more money since he had a second job. His weekly gross went up, so DSS decided he could pay more.
