I think it's legit. Why did the lady say she thought the car was going to catch fire - watching to many movies or she's lying because she did something stupid. Everyone knows you don't move someone with possible back injuries just for the hell of it.

That's still kind of sad though, only in America, anyone can sue anyone, for any reason....

It's common sense. You leave them there unless there is imminent danger. If there's not a fire the car isn't going to blow up - leave the hero complex at home.

If I was in a wreck and had possible back injuries; it would piss me off royally if one person came along and pulled and forced me out of the wreckage when there was no imminent danger and because of their desire to play hero - I'm paralyzed for the rest of my life.

Texas has a good sumaritian law- that protects us. And for the record you move the patient if it is less dangerous than the situation they are in. I am a memeber of the ERT(Emergency resonse team) at work and I responded to a head on collision 3 days ago. We we arrived on the scene- bystanders has already removed both victims from the vehicles- one was on fire. They both were lucky to be alive and one did have a broken Femar(sp), but better moved then burned to death.

That's good - more states need these laws to stop these nonsense lawsuits from clogging the courts. At least the person who was rescued is still alive, IMO that lawsuit is kind of like "biting the hand that fed you".

yeeeeaaaa....i gotta address that whole "wrong" thingy...i MIGHT have been wrong, if there WASNT imminant danger...but if there was, I WAS RIGHT!!!! (for the record...i may have been right...actually, there's just as good as a chance that i am right as there is that i'm wrong!!...i'm a pretty positive, glass full kinda guy, so i'm going ahead with the "i'm right" option...yea...thats better...i'm right! your wrong! it's, again, how it should be)
