    With all due respect to my bros on here who are or were cops, I think the majority of cops are total phucking dicheads.

    I am not an expert on constitutional law and will defer to those on this board who are. I think it is important that we all know what our rights are in the event of being pulled over or having the cops knock on the door. I know the term "Probable cause" is often used to justify cops ripping your car apart trying to find anything that might be illegal. Also, going thru customs is more or less a Constitution free zone, where you can kiss your rights goodbye. Ive been stripped searched coming back from mexico and there wasnt shit I could do to stop it. But with what is happening in this Country, it looks like the Govt wants to control us more and more and take away as many of our CONSTITUTIONAL rights as they possibly can.

    But what are we to say to a cop who says "May we come in?" or "Do you mind if we search your car?"???...As far as I know, we have every right to say 'NO"...please, she d some light on this for all of us and share any experiences you may have had. THANK YOU

    i said no to a search in fla. once. i was a long haired heavy metal head driving a new linc. in the wrong hood, lol. he told me about 4 times how he can call and get a search warrent "like that!" (*while snapping his fingers). i called his bluff and said go ahead...atleast then it'll be documented, and if you tear up anything, you'll be helpd responcible.....he let me go.

      You may refuse a search if asked. If they are really dead set on wanting to find out if there is anything in your house or car, they will detain you and get a search warrant.
      Push it, Pull it, Rack it. Repeat untill wide!!

        dzone , they def search your A## due to your size..u are massive and def they thought u took a trip down there to get aas...u are one big mofo...so u dont look normal.
        but as far as i know AND I COULD BE MISTAKEN, they search u if they thought u had something on or they will get a warrant

          Check out the book "Legal Muscle" if at all possible. It covers this topic and many others like it. It is mainly concerned with your rights involving AAS but it does apply to other areas as well. In any case, you always have the right to refuse any search. But like others have said, all they have to do is get a search warrant.

            I don't think it is all that simple and quick to get search warrants. There has to be evidence for a judge to grant the warrant request. Warrants are not just granted at every request. If you were detained until the warrant was granted, that could take awhile. My guess is that if you refuse to let them in your home, they will return at another time with a warrant. How fast that will be would depend on what they have on you already.

              I would think that they could not detain you if they have nothing on you. If you are not being arrested then on what grounds could they hold you? They will just try to talk to you and scare you to get you to do, or say what they want. I say just shut your mouth and lawyer up!

                Thanks everybody. I was pretty sure they couldnt just get a quick search warrant, especially if they didnt have evidence. I think cops get a green light because people are intimidated and they dont know their rights. Cops often just say, "Step out of your car. Can we search your vehicle?" and most people go "sure" while thinking to themselves "Oh no, now Im really ****ed"...It's important to know what youre rights are before you ever get pulled over so that you can keep a cool head under duress. Cops love to intimidate people and many people cave in. They dont even think of saying "NO" to a cop. It is also important to NEVER admit to anything. If you say "hell yes sir, I was fuc king speeding"...they will write that on your ticket. You then go to court to get it dismissed and the judge will say to you "It says here that you admitted to speeding"...needless to say, you incriminated yourself. Best thing is to play dumb and shut the fuk up. I have gotten speeding tickets before and said "Thanks asshole" and sure enough, I had to explain that to a judge. LOL

                    Speaking of illegal arrests. I just read where Heather Locklear was arrested because some poparazzi jackass called 911 and told them she seemed "tipsy" and that they were "concerned". So she gets pulled over, the photog snaps some pics of the field test and arrest, and sells the images to TMZ for $27k. A fellow shopper that had just seen her in the grocery store was surprised to learn of the arrest because Locklear seemed completely okay just before the incident was phoned in.
                    Now, another thing that gets me. They're awaiting toxicology reports. I thought that shyt had to be court ordered. So they, the cops, can drug test you like that?..on the spot?

                      Coming from a former cop, there's a lot of factors that go into search and seizure, I could go on for days... there are a lot of a$$hole cops that do abuse their power and lie about what happend on the report and they usually can get away with it.. its AMAZING how many people will willingly consent to a search of their car/person/home when they have something to hide... I personally dont understand it, but its all in the way you talk to someone, I think they think that you wont find what theyre hiding,...

                      another thing is about 50-75% of the time, the officer already has a legitimate reason to search your person or vehicle, but is just getting that verbal consent just to lock down that the search was valid,.. there are sooo many legitimate reasons to search your car its rediculous,... one example "sir, have you had anything to drink tonight?" ... "yes officer , I had one beer at dinner" well, this gives the officer PC to search the vehicle for open alchohol beverages,... if you dont have your registration on you, the officer can search the vehicle for it...

                      as far as homes, thats a whoile different story, there is a MUCH higher expectation of privacy in your home.. warrants are usually not very difficult to get, but its not like the movies.. you have to write one up, which takes minimum an hour or 2, then you have to go to the judge and have it signed,.. and if its not during day hours, you have to find the on call judge, and if you come to a judge at 2am, you had BETTER have something good...

                        While in your vehicle, if you refuse a search, the police usually call for a drug dog because the law in most states is that if the dog indicates in any way illegal substances they have their probable cause. Unfortunaly even if the dog doesnt "hit" on your vehicle, they will say he did and they have the right to search. Very wrong but it is regular practice now. If possible, break out your cell phone and discreetly film or photo.

                            Don't carry your shit in your car or you are asking for it unfortunately. One thing I have seen done is this...

                            Douche bag looking dudes driving by, you know he has dope...ok so lets go stop him.

                            Officer:You have any illegal drugs, narcotics, weapons etc?

                            Driver:no

                            Officer:so you dont mind if i search your car then right?

                            Driver: well i would rather you didnt...

                            Officer:Ok (grabs mic and pretends to call k-9) then bullies driver into giving consent...difference between jail vs ticket for possession conversation happens while officer pretends k-9 is en route.

                            -OR-

                            k-9 actually comes, sniff the outside and gets a hit (or doesnt and says the dog alerted) then the dog goes in the car...

                            when k-9 handler is all done he walks over to primary officer and says "you're good to go" then officer searches, finds dope and hooks dude up and off to jail he goes...


                            There is no way to get around a cop who decides he wants in your car if he has no ethics. Your best bet if u have something in your vehicle and u get in this position is to start talking about filing a complaint...no officer wants a complaint, there are other drug cars to stop u r not worth it. Or ask for a sgt to respond and i bet he changes his agenda....trust me

                              Speaking as a former LE, let me advise the following:

                              * Keep in mind that LE does not need a search warrant in order to conduct a search on you or your property. All they need is PROBABLE CAUSE. What is PC? It's a legitimate reason for them to be there and, therefore, search your premises, if they feel the need. And they probably will. In other words, they can be called to your residence because of loud noises (stereo or TV blasting, barking dogs, etc.), domestic disturbances, or any type of disturbances like too many people going in and out of your place. Once LE is called to investigate, they may search you and your place.

                              Of course, they will ask for your permission first. You can refuse, since it is your right to do so. However if you are arrested, they can and probably will search your residence without you there. NOT GOOD!! Your spouse/roommate can prevent it if you have one. But that may still be a big chance if LE pressure him/her enough.

                              * If you've had any previous arrests and is currently on probation or parole, they can search you and your place at any time. In addition, you may already monitored of your current online usages. Trust me, I've seen this quite recently on the website, FriendProject, where I'm a MOD. One of our members was on probation for the possession of kiddie porn. He inquired me about search procedures and I simply told him to make sure that he cleaned up his hard drive if he had any doubt. He didn't listen and they searched his hard drive after having suspicion of his downloads. Now he's doing more time in the poky.

                              * NEVER EVER CARRY YOUR GEAR IN YOUR GYM BAG and IN YOUR VEHICLE. In the event of a traffic stop, they can still search your vehicle. Again, you can say NO to it when asked but if arrested, you won't get that choice.

                              * If LE breaks out with a K-9 unit, you can forget it. You're done.
