Yeah, I've heard that before and I had a long talk with my CPA about and he said this...."Don't pay them and see what happens." Let's face it, you WILL go to jail. Look at Wesley Snipes, if they had no right to take taxes then he would not be in jail. Certainly if there was any accuracy to this, the defendants lawyers would know it. But yet, people go to jail every year for tax evasion, so it's BS.

The truth is this country did in fact start the income tax to help pay for war (I forget if it was WWI or WWII). It was supposed to go away after the war, but it didn't. Since then, the government has changed the tax amount. That required an act of congress, so taxes are therefore legal. If Congress say we have to pay XX percent, then that makes it enforecible.

Anyway, that's how my CPA expalined it to me.

the amendment never recieved enough votes for it to be ratified..therefore its not legal..there was even a supreme court judge that said that its not legal..i'll dig up plenty of info for anybody interested..i have alot of it...

soooo...are you telling me that i should just refused to pay the $5700. in back taxes that i owe becouse it's illegal to tax me and they wont put me in jail if i dont pay?

thats not what im saying...but i AM saying that people have fought them in court and won...because the irs is not able to prove that there is a law when asked to show and proove that a law exsists..because it doesnt...i will post proof backing my claims if you want...

it's not that i need proof...i've heard this FOR YEARS, but people are still going to prison for it. is there a way for us to let lawyers know about this. weasly's lawyer coulda used a heads up, eh? so just TELLING my lawyer this, you'd think that'd be enough so i wouldnt have to pay?...but yet, jail's not really a doable option for me either.

There is a lawyer in my area, that's all he does. He's always in jeopardy of losing his license to, because judges don't like to hear that they aren't staying true to the oath they took when they became judges.

From what I understand on the issue is the anti-income tax crowd is fighting the IRS with a technicality. The bill wasn't "ratified" because the states never voted on the same exact bill. Supposedly, there were errors, typos and different words used in each of the bills that all the states voted on; changing the meaning of the bill, depending on what state your in.

Doesn't really matter to me though. I'll comply with the coercion until we get it changed. Government b@stards!!

it's only tax evasion if you sign the dotted line- then dont pay, if you never sign the "contract" to pay income tax you dont have to if you are an individual>Wesely snipes also has an appeal comming up

if i go with that argument, will you pay any fines or restitution i'd have to pay? i didnt sign for anything...i didnt file (that what they have a prob. with i guess)

Exactly! Look, when guys like Wesley Snipes go to prison for tax evasion, I'm telling you, you can't win. I find it hard to believe that some average joe can win in court against them and a movie star can't get a lawyer that knows about this. People don't go to prison if what they did is not against the law. Yes, I realize that some people are wrongly convicted, but there are a lot of people that go to jail for tax evasion. I sersiously doubt that all of those judges were unaware of this. There is just cause for taxes, if there wasn't then people would not go to jail. It's that simple. If no crime is committed then you don't go to jail. I've heard this whole thing before and I'm telling you, you won't win. Just try and not pay your taxes and see what happens. If it wasn't legal then it would not hold up in a court of law.

I know that is not correct bro because my CPA has told me that if you don't file by a certain date (by law) you get penalized. If you earn a certain amount, you are required to file.

The way I see it is like this......if this was a black and white as you are trying to make it, there would be lawyers out there making a fortune helping people to not have to pay taxes. But, that's not the case because some how or another, you will pay or go to jail.

Like I said earlier, the way my CPA explained was that when congress gets together to change taxes, if it passes then it becomes enforceble. It doesn't matter how it all started, what matters is that cognress has passed tax changes for decades and each time it becomes inforeceble by law. If congress puts something in place, it becomes the way things are, no matter how it got started. The origin of taxes was NOT by law, but changes in the taxes since then ARE by law. That's the difference.

Like I've said, I've had this conversation with my CPA and he stays on top of all the tax laws so I know what I can and what I can't claim. I think he would know if I was able to not pay taxes and get away with it. But hey, if you can get me concrete proof then by all means bro, send it to me. I would LOVE to not pay taxes, I just don't see that ever happening.
