politicians have made AAS a controlled substance in their immortal ignorance

it is just like getting popped with cocaine or meth. the big diff is who has ODed on gear? have you ever heard of a gear related drive by shooting? most guys are buying it for their own personal use even if they buy alot at one time.

it was candering to a special interest group of hyper sensitive parents who feel the government should raise our kids because being responsible and knowing what your kid is doing is too much of a responsibility

Give me a break. These women that are so against women showing sexuality are usually the type of women you wouldn't want to phuck in the first place. So their mad at the world! Then they have a problem with their kids seeing boobs yet kids get breast fed. Quite ridiculous if you ask me!

LiftsIron had this posted on another board insane isnt it

                By Rick Collins, J.D.

Q: What's the heaviest prison sentence you ever heard a guy get for juice?

A: That dubious distinction goes to Donnie Keith Wall, who was convicted of possessing steroids with the intent to deliver them. I found his case in an online search. A Texas jury assessed his punishment at 35 years in prison!

Wall was stopped by the police for driving without a seat belt. He falsely identified himself first by one name, then by another. Finally, he produced an expired license in his own name, and a roadside computer check revealed an extensive criminal record, including a methamphetamine possession charge. Noting that Wall had apparently rented the vehicle under a fictitious name and seeing "drug-related items" in the car, the officer asked for permission to search. Wall refused. He was detained until a search warrant could be obtained, and a variety of oral and injectable anabolics were recovered.

Wall challenged the search and contested the quantity for which the state was prosecuting him. Under Texas law, the penalties for unlawful possession of controlled substances are based on the aggregate weight of the substances in grams. Possessing with intent to deliver between 200 and 400 grams of anabolic steroids is a felony of the first degree, punishable by imprisonment for life or for any term between 5 years and 99 years.

The crucial issue was how to quantify steroids under Texas drug laws, which call for including in the aggregate weight any adulterants and dilutants. Why? In a cocaine or heroin case, it's obvious. You'd weigh all the aggregated powder because that's how the product is commonly bought and sold. If you buy an ounce of coke, it's an ounce of powder, period. The purity is a different issue. When it comes to anabolic steroids, it's a whole 'nother thing. Sure, injectables contain water or oil and tablets have binders and fillers. But people buy and sell gear based on the milligrams of androgens, not the quantity of oil or total weight of tablets.

Under the Texas case of Cawthon v. State [849 S.W.2d 346, 349 (Tex. Crim. App. 1992)], when adulterants and dilutants make up a part of the weight of a controlled substance, one thing the State must prove is that the adulterants and/or dilutants were added to the controlled substance with the intent to increase the bulk or quantity of the final product. Wall's lawyer, Lawrence Cerf, Esq., of Houston, made all the right moves by calling an expert who testified that the non-steroid liquid (i.e., oils and/or water) and solid substances (tablet binders and fillers) in which the steroids were found were not adulterants or dilutants added to the steroids to increase the bulk. Rather, he stated that the non-steroid portions were simply carrying agents. The State, however, called its own expert who claimed that the non-steroid portions were added with the intent to increase the bulk. While reasonable for powdery substances like cocaine, where the black market quantity bought or sold inherently includes various cutting agents and fillers, such a claim seems inappropriate if not ludicrous for anabolic steroids.

Nevertheless, the jury - located in a county that sits on the pipeline of narcotics from Mexico and is known for heavy sentences in drug cases - bought the prosecution's arguments. In fact, Wall would have been sentenced to life in prison but for one holdout juror out of the twelve! On appeal [Wall v. Texas, 878 S.W.2d 686 (Tex. Crim. App. 1994)], Wall challenged the legality of the search warrant, but lost. The Court of Appeals of Texas rejected his argument that he was illegally detained until the warrant had been issued, holding that an arrest is legal when a driver lacks a valid driver's license. As to the quantity issue, the Court shrugged, claiming to be "jurists, not chemists." They affirmed the jury's conviction. A further appeal to the Texas Court of Criminal Appeals was denied. While Wall was no choirboy, his harsh sentence was primarily based on the misapplication of traditional narcotics quantity concepts to anabolic steroids.

                  Re: what is the..

The great american injustice system at it's best! Unbelievable! I love how the judge says "We're jurists, not chemists"!!! That's their job to know the specifics of a case if they are trying it.......

But it should come as no surprise that redneck states have judges like that, whom aren't true to the constitution or to true justice. They honestly believe they are the law, and are above the law which is quite scary. They are the type (like bush) whom are ruining this country!

I have heard of several BB's who have needed major organ transplants, heart surgeries and been in the hospital for various infections from gear that was not steril. All that is avoidable, but yet, causes the INS companies to to fork over a lot of money, causing people and businesses to pay higher premium rates. I know, there are very obeses people who cause the same thing, which could be avoided; I see it every night at work and it disgustes me. I am just saying that there are logical reasons to out law it. Personally, I don't care one way or the other.

                            Re: what is the..

The thing about this topic is. The federal "Minimum mandatory sentencing" guidelines are so vast there is no way to tell. They are required to evaluate total weight in grams of the substance or substances to asses the "level of the crime and previous record.

                            read this http://www.ussc.gov/2005guid/2d1_1.htm

there are guidelines there for assesing the "level" based on the quantity you posses. Minimum level is 6 however if an airplane was involved in the import its a minimum of 2 level increase per the guidelines and if you used a "federal communication facility" aka post office to distribute its a minimum level of 12. then that level is adjusted based on previous record. IE three strikes and your out for felonies.

looks like level 20 is the highest you can get for aas or other class III not listed there if your clean and didnt violate any other laws along the way..ie import with a plane or using the federal communication facilty etc etc .. so with no recs ur much better off. if you read the penalties as listed you will see that heroin is the most harshly punished substance followed by crack and cocain and other methamphteamines (Sp)

                            BUTTTT

                            whats a level 20

                            20 33-41 37-46 41-51 51-63 63-78 70-87

ok so that read across to 33-41 years is the minimum mandatory federal sentence for a CLEAN prior who posses 40K or more "units" of a schedule III substance.

but lets say you escape with the minium on a clean record and get a level 6 lucky you

                            6 0-6 1-7 2-8 6-12 9-15 12-18

the max time ther eis 18 years if you have a "criminal history points total" of 13 or more. and 0-6 years if ur clean.

so all in all. the penalties DONT fit the crime IMO but to say they are just as bad as other substances is a stretch as well. but i do believe they work harder at busting juice dealers and i dont know why at all. it doesnt make sense

I try to explain it to people by saying this. Do you know anyone who smoke? do you know anyone who has taken steroids? DO you know or are you related to anyone who has recieved treatment for cancer or other diseases or died for something related to cigarette smoking?

do you know anyone who has recieved treatment for a disease or died from steroid use. the answers are overwhelming. Most know someone who died or is dying from cigarette related illness..almost know one can name a single instance of someone dying or dead or recieving treatment for steroids except the occasional.. i knw this guy who got a bad infection....

so i ask you. why can i walk into any store or gas station in america and buy a pack of cancer stick but i cant walk into a pharmacy and buy steroids"???
