  • Need help & advice right away...

Ok guys..I think I got myself in a little bit of trouble here.

Here's..whats happening.. I rented this house in the mountains...100 miles north of Boston..great place and all...got the house for 2 nights...Dec 31st..and Jan 1st.. I had about 20 people there..we all celebrated new year..it was fun...then we decided to leave on Jan 1st..because we didn't have any food there.. and we had to leave because of the weather getting worse. So in the morning there was about 10 of us..we all left at once.. I was the one who locked the house ...left the key inside the mailbox and called the (owner) telling her I'm leaving early for the reasons I described above..I left a vm on her cellphone because she didn't pick up.. The house was left in a mess..nothing broken or damaged..just alot of trash.. and messy looking house after all..now I couldn't control 20 other people (I got the house under my name and all)..I can't babysit everyone and tell them how to behave and what to do. So..we are driving back home on the highway..and my cell rings..I pick up and its the Police Department.. and the officer tells me I want to talk to you about some stuff that was just missing from the house after you left. The owner that rented me the place called the police on me.. accusing me or my friends that we stole her projector screen.. then projector itself... and some other small..stuff.. now I know for a fact that nobody from myself or my friends stole this stuff from her house...when we left..everything was still inside the house.. all the stuff that she reported missing/stolen.

The officer then gives me hard time.. telling me how this is serious..how its a felony..blah blah.. how he can issue arrest warrant againts me..how he will send a trooper to search my car.. all this nonesence talk.. so..we finished up conversation him saying "this will be under investigation".

About 6 hours later... a male calls me.. claiming to be the husband of the owner.. saying "oh we just updated the list...the 37" tv is also missing.. and a Playstation 2 system... Then he tells me I have 24 hours to give him his stuff back..or he will come after me with the police.. he was saying how police was in his house that morning..taking pictures of everything...there were detectives..taking fingerpringsl....wtf...SOUNDS LIKE someone got killed or some ****.. then he calls me YOU DICK..YOU WRECKED MY HOUSE... this and that... so what I think is nothing was stolen from their house they are just mad the way house was left.. so they made up this **** that all this stuff was stolen.. so they can get some revenge on me for making their house looking all messy.

Again..nothing in the house was damaged at all..except alot of trash.. mostly beer bottles.. blown up baloons on the floor.. some papers.. stuff like that... she didn't even ask me for security deposit or anything like that...

Since the house was rented by me, under my name.. what can happend here right now.. they DON'T have any proof that I or my friends stole the stuff.. which we didn't in the first place YET we are being accussed. I keep getting calls from this mother****er threatening me.. with all different stuff..etc..etc..

Oh yeah..then he says..thx god I have half insurance on the house and this stuff..

What can I do..to avoid trouble firstly with him then the law..

Can they actually issue arrest warrant for me..or this most likely will be handled in the court ?

Well if you're the responsible one and the one in charge, I would've cleaned up, I don't understand why you would leave trash laying around all over the place thats not even yours that you rented, no offense.

Second was there any kind of agreement or contract with rules signed between you and the owner?

If you have a lawyer I would give him a heads up about it and see what he says.

You say there were 20 people at the house at nite, then in the morning there were only 10, so how do you know that noone carried the tv outside while you were asleep? I mean I don't know what kind of people you had at the party. Did you know all of them? Are they trustworthy?

If they're really wasn't anything stolen, then they really have no proof, unless they have hidden cameras in the house who knows.

Re: Need help & advice right away...

Ok, first off you should have cleaned. That whole thing about not being able to control 20 people, I don't agree with. These are your friends, right? And they would just make a mess of something that was in your name and leave it? Phuk that! My friends would never do **** like that to me, never.

Aside from that, when it comes to theft, they must be able to prove they owned the stuff. Here's where you get phuked....if they have the stuff...say...in their personal house and show the police the receipts, then they can say 'this stuff was in the house'. Let me ask you this was any of this stuff in the house when you were there? If no, then you better get every person who had a camera that night togive you copies of all the pictures they took. Someone always has a camera and if you can show the police that the stuff they claim was there actually wasn't, they will be phuked. But, if they have receipts, and they say it was in the house and it's gone now, you could be phuked.

I'm with MCK on this. If these people didn't care enough about you (I'm not talking about ALL of them) not to clean up a house that's in your name, how can you be 100% sure that one of them didn't see you put the key in the mailbox and go back later and steal stuff? Did you know every single person in there well enough to say they would'nt do that? Here's what I'm getting at...if there's no forced entry, then it had to be an inside job. You obviously will be the number one suspect.

But, I do have one more question...was the key in the mailbox when the owners showed up? Because, if the key WAS there and the stuff WAS stolen then I can guarantee you, it was someone who watched you put the key up. But, like I said, if you can get the photos that were taken that night and show the cops that even one thing they claim wasn't true, you just got them for filling a false report which pretty much puts them in the untrustworthy catagory with the cops. I can guarantee you, they cops showed up and took photos of every place they claim something was, you need to get photos showing it wasn't there. That's about the only way I see you getting out of this. Well, unless they have no receipts to prove they even owned the stuff, without being able to prove you owned the stuff they can't press charges. Think about it. What if I said $5,000 in jewelry was stolen from my house during a party and had no proof of owning it, I'd have no case.

Get the photos bro, get them asap and take ALL, and I mean ALL of them (and a few of your friends) to the cops personally and show them and talk to them. Coming from someone who's had more than their fair share of experience with cops, the best thing to do is cooperate. If you have nothing to hide, you have nothing to fear and you should immediately give them permission to check your house your car and given them the name and number of everyone that was there. Trust me bro, that's not something a guilty person does. Call them and invite them over to your house immediately and give them the contact info for everyone there.

I'm telling you though, if the stuff is in your photos too and not there now, you could really be phuked. So, IMO, cooperate with the cops asap and give them full rights to search anything and everything you own. That is if you have nothing to get you in trouble. I'm not saying you took anything, but if you have 'anything' else that may be bad.

Oh crap, I didn't think about the hidden camera thing. That's becoming more and more popular these days.

Bro, sorry to say this but if you are renting a place you should be much more responsible, and if these ppl made a mess of the place it is your responsibility to clean it up. Imo, these ppl have every right to be upset. Also, ive rented places b4 and most everyone if delt with make you sign an itemized list of things that are in the residence b4 you rent it, and then afterwards you go over the check list. That way there is proof on both sides that nothing was taken. Even so..don't these ppl have homeowner insurance to cover this?? I doubt 007 that these "friends" took pic that would reveal anything. All the owners need to do is provide proof in receipts or pictures of the items. One thing that was kind of dumb on their part is to have the renter drop the house keys in the mailbox. that is one of the first places a thief would look to break into a home. Even insurance claim ppl would frown on this. Its like leaving your keys in the car and then saying someone stole your car, lol!

You can't file a claim with home owners ins without a plice report. And, they will verify with the police it's legit before they pay.
