a moped rider is not considered a biker..Probably just a a long time resident in a leisure ride. But Billy fugged up royally. I guarentee he was drinking and trying to pass on the double yellow.. thats just plain fugged.
He'll do time for this one.

or he wasn't drinking and is like a lot of dodge ram truck drivers and just impatient and pushed it to the floor...I've seen way too many close calls with people like that with some power under the hood...and we all know he loves power and speed...but if he was drinking then yeah, he's not going to be a happy person...

just read about 7 article on this.. apparently he was awaiting trial in early Oct. for drunk driving. he refused the breath test. So the most they could do to him is suspend his licence for a year.
They didn't charge him nor write him a ticket. If they would have given him a ticket for crossing the double yellow, and he went to court over it.. They could not then use that in a criminal case. Double jeapordy would apply.
So they're awaiting the blood test because the cop smelled alcohol.
usually 6 to 8 weeks, but they are trying to push it through faster...
Brother of the victom says the guy was a fun loving man that used to help kids child psychologist..

actually if he went to court for crossing the double yellow line, they could still use that in a criminal case. double jeopardy doesnt mean that things cant be used in more than one case. it means he cant be tried twice for the same crime. vehicular homocide and reckless endangerment are two very different crimes and he can be tried seperately for both (but they would just charge him with both and trie him for the vehicular homocide).Originally posted by basskiller View Postjust read about 7 article on this.. apparently he was awaiting trial in early Oct. for drunk driving. he refused the breath test.
