    Inmates sue to overturn nude magazine ban

    INDIANAPOLIS - Two inmates have filed a lawsuit against the Indiana Department of Correction to overturn a policy that bars magazines such as Playboy and Hustler.



    The lawsuit filed Tuesday in U.S. District Court in Indianapolis seeks class-action status on behalf of more than 20,000 state prisoners and challenges a policy that went into effect July 1 barring adult magazines and other printed material that depict nudity or sexual content.

    The policy could prohibit sexually explicit letters and publications such as National Geographic magazine and daily newspapers, according to the complaint, which said the new rule violates the plaintiffs' civil rights.

    "The policy is written so broadly that it includes within its prohibitions such things as personal letters between prisoners and loved ones and much of the world's great literature and art," said the complaint, which was prepared by the American Civil Liberties Union of Indiana.

    One of the two plaintiffs named in the complaint is Ernest Tope, 53, an inmate at the Pendleton Correctional Facility near Anderson who is serving a life sentence for murder. He claims he cannot subscribe to the motorcycle magazine Easyriders because it contains partial nudity.

    The policy may also may bar books such as steamy novels by the best-selling author Jackie Collins that have been available in the past through the prison library, the lawsuit claims.

    Both Tope and the other named plaintiff, murder and auto theft convict Wade Meisberger, 34, challenged the new policy through the prison grievance system but so far been unsuccessful, the complaint said. Meisberger, 34, is held at the Miami Correctional Facility near Peru.

    DOC spokeswoman Java Ahmed said agency officials had not yet reviewed the lawsuit and had no comment.

    I guess but not everyone in there rightfully deserves to be their, so I too would be fighting for my rights If I were them!

        Everyone at some point in their life rightfully deserves to be there. Some of us just don't get caught when we should have....Karma in full effect baby!

              I think they should not get jack crap they have better medical them most americans. take away tv, weights, and put them on a chain gang and make them repay society. I have a good idea you know those jobs that illegals take b/c americans dont want them have the inmates take them.

                    Wouldn't you agree that porn is a luxury item? why do they need to have any "luxury" items? They wont die without it, right? Well, aside from any on death row that is...but really, death row inmates rarely die....

                      I'm not saying the serious criminals should be able to have those luxuries. But sometimes people that have simple shit like traffic infractions are put in with criminals. I'm not even talking about drunks. A lot of times people are put in with serious criminals when they don't even belong their. Those are the people I few shouldn't be punished so harshly. Sometimes are system is unjust. Actually most times our system is unjust. It is set to protect the powerful.

                        A vast majority of people here use AAS. With the laws changing the way they have all it takes is for you to slip up once and you will be in there with those "phuckers" wishing you had some porn instead of having to jack to Victoria Secret adds.

                          So everybody should be in jail? WTF? Plenty of people are convicted of crimes they did not commit. Witnesses lie and/or forget. Cops trump fake evidence. Some stupid people even confess to crimes they didn't commit if they are questioned for 24 hours without sleep. I like having prisons, but I know it is a flawed system.

                            What i was trying to say was in reponse to dj's reply was that the inmates who are locked up unjustly for a crime they didn't commit should just deal with bc at one point in their life they have probably gotten away with something that would have landed them in lock up anyways...Thus the Karma remark.
