Mick-G is right Mikey. Either that or use the figure Mick wrote and tell the insurance person, you want 30k for pain and suffering or you letting your attorney take over the issue.
i did that!! 30k maxed out this guys policy...i told them to pay it, or i'll go after that plus future med, and everything else i deserve...they had the check ready the next day...

It is extra bad too Mike that you and she have the same insurance, because your insurance isn't looking out for you either because they know they are apt to get sued over this. I bet the first thing the insurance company asked you is how you are doing and if there is anything wrong, Iam i right?? They will act really concerned and like they are your friend, but trust me the only thing they want to know is if there are any permenant health problems, or anything ongoing, and if you said no you are fine, trust me they will have documented that you said that, so they can use it if you should file a suit. The woman also prob acted really nice to you right?? All you had to say is that your not fine and your still having head probs, you didn't have to answer any other questions. This could have been an easy 20-30k for you easily and with not much time, cause the woman is insured for this at least 500k on her policy, and the insurance knows it is easier and less expensive to pay it off. I would have just had my attorney type the insurance co. a letter on your behalf explaining you pain and suffering and that you are wanting,... hell id tell them 40K, lol! My attorney would have just charged me for the letter. Then i could have taken home all the $ without 1/3 taken out.
Mick-G is right Mikey. Don't accept anything from them. You take that check and as far as they are concerned alls done with this claim. In a month if you fine out you have something wrong that is related to this, you are screwed. Make sure you get all that's coming to you right now. Get an attorney that specializes in these matters. Yes they will probably take a 3rd of it, but they will get you a lot more than what the insurance is goign to give you.
