Well I emailed the FCC and as I stated in the prior thread, TM's won't be calling your cell phone. Here is the reply directly from the FCC.

Yeah that's what my company said too, because we have company issued cell phones and everyone was worried that the TM's would be calling those numbers as well. The company sent out a massage e-mail saying that TM's would not be calling unless you signed up for it.

LIC.... What exactly did you ask in your email? If you don't want it public you can send me a PM and I'll give you my email addy. I'm kinda reading between the lines here but if I had to guess you probably just asked them if your number was going to be released and then they sent you a response just like they have to thousands of others saying that its not true. They do not want to cause chaos among the billions of cellular customers. However, Here's the skinny on the whole deal.

IF you weren't specific and asked them if there was any possible way that your number be released to telemarketers then they probably just said No its a rumor and your fine... There's laws prohibiting all wireless phone companies to release your phone number to any 3rd party without your concent, but here's where they can get you. Effective Jan. 1st. All cellular companies get kick backs from Telemarketing companies if a number is released to them. Kinda like a purchase but they place things in a gray area which allows them the loop holes to work without being penalized or pending lawsuits. When you sign a contract with ANY cellular company there is tons of fine print, in most but not ALL contracts there is a clause that states that YOU the customer is "opting in" for your number to be released to 3rd parties. If the sales rep doesn't explain this and you sign a contract and are opted in then your number is released. It is important to know that some cellular companies are not participating in this "opt in" program but most of the larger ones in the US are. I can't stress enough though, Your number will not be released without your concent but it can and will be released to 3rd parties if you do not read in detail what your contract states. I just don't want anyone to get the wrong idea and have a false sense of security. Here's an example of how easy it is to get you to sign.

Say you go to D-S Cellular and get a new phone, well when D-S activates your phone and prints out your contract there is a place where you can "opt in" to have your number released. Most cellular contracts have 3-4 places to initial and then a signature at the end. I say, "Ok mr LIC your phone is ready and I just need you to initial here,here and here stating that you understand you are signing a two year service agreement and that you understand our terms and agreement." You say ok, and then you start writing. Let's face it, most people do not read the entire fine print. And your sales rep D-S was in a hurry and didn't even ask did you want to "opt in" to receive calls about specials or promotions, he just checked the box on your contract and you signed it...3 days later, you'll recieve your first telemarketing call.

And that's how it works, and it is working. If you need further info send me a PM and I'll be more than happy to forward you an email showing you more in detail. Also I can try to show you an actual contract with an example.

Below is the exact question I asked from the email sent to them. Their email is fccinfo@fcc.gov

Just trying to find out if it is true that telemarketers are going to start being allowed to make voice calls to Cell Phones beginning on January 1, 2005? Is there some type of loop hole that they will be able to jump through even if "technically" they are not supposed to be calling cell numbers?
