A few weeks ago, I was pulled over for speeding. After all the routine crap, the officer told me I had a warrant for my arrest for terroristic threatening, from a city 300 miles away from where I live. I told the officer that it was a mistake (isn't it always) but I was arrested. When we got to the jail, the officer claimed to check the warrant and said it was a warrant for my arrest. Several hours later I made bail.

Turns out I didn't have to go to court, because I provided enough evidence over the phone that the Sheriff's department was convinced it was another Klash and they dismissed it so I wouldn't have to make the 5 hour drive to defend myself but now I'm out $200 from posting bail but would have been out much more if I wouldn't have; considering I was going to be extradited to the county the "crime" took place and would have missed several days work.

Can't get my money back from the bail bondsman, I technically hired him to do a job. The victim didn't file the complaint against me but another Klash, so it's not a false police report. The Sheriff put a warrant out for Klash's arrest but had no other relevant information on the warrant.

So if your ever in this situation have the officer check the warrant and if they say it is right ask them to check again. Damn government!

But at the time, they had enough probably cause to arrest you; so they did...Once your fingerprints were scanned or once the NCIC report came back good, well you were let go.

They didn't find me innocent. I posted bail, so I could go to work the next day.

Nor did they find you guilty either...You never went to court right? And you can get your money back if you CAN prove this was an unlawful arrest...I'm a skip tracer(sort of like a bounty hunter)and they can too give you your money back, but it's a process...If the arrest they made was really not you...You need to call the clerk of the courts in your county...Call the bonding agency who bonded you out and ask them who's their insurance agency...The fee you paid to get bonded out is a fee we get paid to do our jobs...So he really doesn't have pay you back, but in his clause and by law, you are entitled to your money...

Like I said; it's a process...So your bond was $2K right? Call the clerk of the courts and get a report from the local sheriff office who arrested you claiming you were let go due to insuficient evidence or due to the fact it was not you.

      Right, bond was $2000.

I actually had the Sheriff from the department that issued the warrant call the Bail Bonding company (BBC) and the BBC stated "no way in hell, am I giving his money back".

      Any suggestions?

Hmmm...There's something not playing out right here...Either you're not telling the whole truth(not saying you're not)or you're being fkd without the KY...Like I said; call their insurance company up and tell them what happened...The last resort is going to small claims court, which is what I would do...Once you file papers in court and they get notified, more than likely they will pay you back the money...Like I said, it's a process...But you can get your money back.

that is horrible bro I hope that all gets worked out for you. I would definately look into small claims court, the bondsman sounds like he is lying telling you he is not insured.

Well technically, he said they insure themselves and they don't have an insurance company.
