Fox News' "Hannity & Colmes" news talk show was scheduled to focus its Friday night segment on a self-ordained Huntsville preacher who will serve no time in jail even though he pleaded guilty Monday to molesting three adopted boys.
Tom Holmes, a producer with show in New York, said the case of Jerry Wayne Love is the kind of story the show's producers could not pass up.
"In a case like this we like to shine a light on it to show people what is out there," he said. "He is a man of the cloth who admitted abusing these children and will not serve a day of his sentence. We feel we need to let people know about that."
Huntsville police investigator Fred Sharp testified Monday that Love for years had molested three boys he and his wife had adopted in the 1990s. The Alabama Department of Human Resources named Love and his wife foster parents of the year in 1999.
Love was charged with 13 counts of sodomy and sexual abuse. Nine of those charges could have resulted in a life sentence if he had been convicted by a jury.
But Assistant District Attorney Allison Palmer and Love's lawyers, Steve Aldridge and Alan Davis, struck a deal before the trial started. Circuit Judge Karen Hall sentenced Love under the prosecutor's recommendations.
The prosecution offered the plea agreement to spare the boys from having to testify against Love, Palmer said.
Love pleaded guilty to three charges and received 15 years on each charge to be served consecutively, but went home on five years' probation. The other charges were dropped.
Hall ordered Love to register as a sex offender and enroll in a sex offender treatment program.
