Tweethey , didn't know where to post this, but i need some information on BC canada law, not in regards to steroids, but lets say you are at a park, completely sober, do the cops have the right to search your car, take your name, make you pour out CLOSED beers that are in your car (and remembre you aren't drinking) ... i just want to know my rights next time 6 cop cars for a combined totaly for 12 cops show up for 6 guys meeting up before they go to a party (all still sober) its rediculous, all they did was take our names and peace out but still one cop opened my buddys car door and started looking around, im thinking that is illegal and i told him and he is like "jr lawyer over here, and he did n't search my car (Thank god) ... its bullshit

They have to have probable cause to search you, your car, and take your name. was it RCMP?? Next time tell them to either get a warrent or fuck off.

Tweetso i went to the cop station today to ask some questions about the law and my rights
we weren't parked inside the park, so we avoided the "park closed" speech.
we are all 20,21 or 22, just meeting up before a party, we had closed beers which we found out we dont ever have to pour out .. even if drunk and walking home it woudl be hard for a cop to charge you with drunk in public, and still couldn't make you pour out your booze
the cop was in the wrong for searching the car without
a. consent
b. probable cause
c. warrent (which takes probable cause most of the time)
and i was asked if i wanted to file a complaint (i said no cause it would take liek 45min of bullshit and we didn't want to)
and i asked a bunch of other questions that im not gonna bother writing about, but it was interesting nonetheless

Here's the deal. Technically he can't "search" the car. However, the law is pretty damn shady in this respect.
Keep in mind that a cop can and will invent "Probable cause" at his will. From what I've seen, that can mean anything from "Looked like they were dealing drugs" to "I thought I saw a baggie in the back seat".
If no-one was drinking, everyone was of age, and the alcohol was stored in the trunk, he shouldn't have been able to pour it out.
Technically it's not legal to carry open alcohol on your person in a public place. In the case of beer, if the case has been opened, it's considered open alcohol. So if your walking home with 5 our of 6 beers in your 6-pak, the cops can technically make you pour it out. Some thing goes for walking home with a 1/2 bottle of wiskey in your backpack.
