Towing issues still arise despite city ordinance

"Road rage" is fast becoming a familiar phrase in American travel.
However, "tow truck rage" is not.
Dallas has been fighting for years to enforce a towing ordinance - but some people still don't think it's working.
Alma Hibbert's story is like dozens of others over a dozen years. She parked her car and left it. It got towed.
"I had to pay $201 to get it out," Hibbert said.

Hibbert often parks her car in a Target lot in North Dallas, then gets on a bus and goes gambling in Bossier City.
The most recent time, when she got back the next day the car was gone.
"I had no idea where my car was," she said. "I was scared to death."
A sign nearby said, "No Trucks Allowed." At another place in the lot, different warning signs are posted. However, A.J.'s Towing, which towed Hibbert's car, said there don't have to be signs - it can tow anyway.
Larry Carter can identify with Hibbert.
"It's a crying shame that they get away with this stuff," Carter said.
A.J.'s towed 137 cars from inside his locked, fenced body shop.
"We had a row of cars starting right here, and then two rows," Carter said, pointing across his empty lot. "And then we had this double row parked here."
Carter said a vengeful former employee unlocked the lot on a Sunday afternoon, posted signs declaring the cars were parked illegally, and had them towed to a lot which stores vehicles that towed by A.J.'s.
Lawyer Jim Mosser represents A.J.'s, as well as S&J - the lot which stores the vehicles - and other towing companies. He also represents Troy Compton, the former employee who arranged for A.J.'s to tow the cars.
Mosser said A.J.'s had a contract to do the towing. Mosser was asked if A.J.'s could provide News 8 with a contract.
"I'll see if they can," he replied.
That was on Monday. Tuesday, Mosser told News 8 he could not provide that contract.
Larry Carter, meanwhile, is quickly going broke. His case is, like many other questionable towing cases before, multiplied - in this case, by 137.
"They want a $23,000 fee, plus twenty-two hundred something per day for 137 vehicles," Carter said.
So how can so much questionable towing happen? Ask the City of Dallas.
"The city of Dallas has been sued several times over the last decade," said assistant city attorney Chris Bowers.
The city has a towing ordinance that defines who can tow, how they can tow, and what tow-warning signs must say.
"It is under challenge in four lawsuits as we speak," Bowers said.
How can they challenge it?
"They hire lawyers," Bowers said. "Lawyers look for opportunities."
So does Mosser get sued a lot?
"I don't think so," Mosser said.
Does A.J.'s get sued a lot?
Replied Mosser, "What's a lot? I couldn't tell you."
How many times a year does A.J.'s get sued?
"Oh golly, I couldn't tell you," Mosser said.
Dallas officials said the city alone brought 23 cases against A.J.'s in the last year for towing overcharges.
"I get some complaints, we respond to them," Mosser said. "S&J gets some complaints ... we respond to them in a legal fashion so that we can answer the issues that are at hand."
These cases usually end up as civil matters, but the city attorney said they don't have to. In the 137-car case, the police officer who was contacted refused to even write it up.
City attorneys said the the Dallas County district attorney could choose to take big towing cases to the grand jury - but so far, that hasn't happened.
