TweetI heard about this on the news. Very sad.
TweetCalling bullshit on this one. If he had his plan before 2010, any insurance plan in existance before then and their policies do not have to comply with Obamacare. ( Bet everyone forgets that.). Insurance plans are using obamacare as a convenienty scapegoat to renege or discharge patients that are money losing propositions. That's what happened in California with United's individual policy plans. They had only 8000 policy holders compared to their competition who had 2 million. Obamacare does not prevent a private insurance plan from withdrawing from a market that is a money losing proposition. That would be socialism.
TweetALso, he can get tax subsidies to pay the premiums for any on the healthcare exchange plan since none of those can rescind or penalize him for having cancer. I believe he would qualilfy as it sounds he is already financially destitute from paying for his cancer care from his ( great preObamacare insurance policy)
TweetIn other words, if you have a plan that existed before march 23rd, 2010 from your employer or individual policy they can still cancel your plan because you got too sick, it's called Rescission, and they did it all the friggin time to my patients before Obamacare except my patients could not blame him. any policy obtained after 2010 cannot do that. If what he claims is true, his plan was canceled due to his cancer, they practiced rescission, the very practice obamacare got rid of with any plans born after march 23, 2010 to protect our future generation from this most vile of all insurance practices.
TweetIf you notice, all the patients are cancer patients, so the grandfathered plans are taking advantage of obamacare to discharge their patients and switch them to higher premium plans ( without telling them they can go on the exchange) and practicing rescission en masse.
If you don't believe me when I say none of the grandfathered plans that existed before March 23rd 2010 and their renewal policies after 2010 are subject to Obamacare expansion of benefits and restriction of abuse go to..
Section 1251 of the Affordable Care Act, Preservation of Right To Maintain Existing Coverage (26 CFR 54.9815– 1251T, 29 CFR 2590.715–1251, and 45 CFR 147.140)
The Affordable Care Act specifically outlined how health care plans that were in effect prior to the ACA being signed into law on March 23, 2010 could be “grandfathered” and people who purchased these plans through their employment, as a part of the group or as an individual could choose to continue to be covered under their plan EVEN IF IT DID NOT MEET CERTAIN STANDARDS REGARDING ESSENTIAL BENEFITS SET FORTH BY THE ACA. Waht they forget is the plans can play their rescission games with abandon, especially with cancelling cancer patients, with complete abandon and now peg it on Obamacare! If I was an insurance excecutive, I would pat myself on the back for this!!!
